NO PURCHASE NECESSARY TO ENTER TO WIN, NOR WILL MAKING A PURCHASE INCREASE YOUR CHANCES OF WINNING. MUST BE 21 YEARS OF AGE OR OLDER. VALID EMAIL ACCOUNT AND INTERNET ACCESS REQUIRED
ELIGIBILITY:
AMPM “Atlanta Braves First Pitch” Sweepstakes (the “Sweepstakes” hereafter) is open only to legal U.S. residents of the state of GA who are 21 years of age or older and have a valid email address and internet access at time of entry. Employees of Georgia Oil Holdings, LLC (the “Sponsor”), Clipper Petroleum, AMPM, convenience retail companies, independent gas station owners and their employees, Atlanta Braves and their employees, Sponsor’s advertising/promotion agencies, their respective parent companies, affiliates, subsidiaries and agencies, and any other entity directly involved with this Sweepstakes, their immediate family members (parents, children, siblings, spouse) and members of respective households of these entities (whether related or not) are ineligible to participate in this Sweepstakes.
ENTRY PERIOD:
Sweepstakes begins at approximately 12:01 AM Eastern Daylight Savings Time (EST) on 08/09/10 and ends at 11:59PM EST on 09/06/10 (the “Promotion Period”).
HOW TO ENTER:
There are two (2) ways to enter during the Promotion Period: (1) Online. Purchase any 1 hot food item or fountain drink from participating AMPM locations, receive a flyer with the ID code, visit the sweepstakes website at www.idealsweepstakes.com/ampm_braves, enter the ID code, complete the online entry form, and submit. The use of automated entry devices of any kind is prohibited. All entries become the property of the Sponsor. To be eligible for participation in the Sweepstakes, each online Entrant must input all required data on the Sweepstakes Registration Form. Incomplete or inaccurate entries shall be deemed void. All entries must be received by no later than 11:59:59 PM ET, September 6, 2010.
(2) By Mail. To participate without purchase, send a hand-printed 3″ x 5″ card that includes your name, age, complete address, including zip code, daytime telephone number, email address, if you have one, in a stamped envelope to: AMPM “Atlanta Braves First Pitch” Sweepstakes, 625 Panorama Trail, Bldg. 2 Suite 100, Rochester, NY 14625-2437. Limit: one (1) entry per envelope. Each entry must be hand-printed, and received by September 7, 2010. Neither the Sponsor nor the Sponsor’s Affiliates are responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated entries or postage due mail. Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. Entries received in envelopes larger than a number ten (#10) standard-sized 4-1/8″ x 9-1/2″ envelope will be automatically disqualified. All entries become the property of the Sponsor and will not be returned. Sponsor will attempt to notify potential winners only.
Limit: One entry per person regardless of method of entry. In case of multiple entries during the promotion period, only the first entry will be accepted. Collection and use of personally identifiable information will be conducted in accordance with the Sponsor’s Privacy Policy posted on its Web site.
Random Drawing/Winner Notification: The Grand Prize winner will be selected in a random drawing, taking place on or about September 7, 2010, from among all eligible entries received. The random drawing will be conducted by US Sweepstakes & Fulfillment Company, an Independent Sweepstakes Administrator, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning in the Grand Prize drawing will depend upon the total number of eligible entries received throughout the entire Promotion Period. Winners must comply with all Sweepstakes rules as published. Potential Prize Winner will be notified by phone and confirmed in writing that they are a potential prize winner within one business day of the drawing date. In the written notice, the Independent Administrator will provide all necessary documentation that the winner must execute before being entitled to redeem their prize. The Grand Prize Winner will be required to execute and return an Affidavit of Eligibility, a Liability Release, and, where legal, a Publicity Release (collectively, the “Release Documents”), within three (3) days of written notification. Return of prize or winner notification as undeliverable; failure to respond to notification; failure to reach the winner and/or failure to provide required proof of eligibility, failure to return fully completed and executed Release Documents; and/or failure to provide any other required documentation in a timely manner may result in disqualification and selection of an alternate winner. Non-winning entrants will not be notified. Winning a prize is contingent on fulfilling all the requirements set forth herein. Winner is responsible for all federal, state and local taxes, if applicable.
PRIZE:
There is One (1) Grand Prize available to be won. The Grand Prize package consists of four (4) tickets to the September 15, 2010 Atlanta Braves home game and the opportunity to throw the Ceremonial First Pitch (“Prize”). Any games other than the September 15, 2010 game are not available as a Prize. Winner will be provided with an AMPM t-shirt to wear during the First Pitch. All other expenses not specifically mentioned herein (including, but not limited to, food and alcoholic beverages, transportation to/from the game, parking fees, etc.) are the sole responsibility of the Winner to pay. Winner and guests must attend the game together. Guests have no independent rights to the Prize. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value. Odds of winning the Prize will depend on the total number of eligible entries received at the time of random selection. Approximate retail value of the Grand Prize is $96.
GENERAL RULES:
No transfer or substitution of any prize or portion thereof is allowed, nor is there a cash value equivalent, except at the sole discretion of the Sponsor. If any prize or prize notification email is returned as undeliverable, if winner is unable to attend the September 15, 2010 Atlanta Braves home game, prize may be forfeited and an alternate winner may be selected. All federal, state, and other taxes are the sole responsibility of the Winner. Winner’s entry and acceptance of the prize constitutes permission (where allowable) for the Sponsor to use said Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation.
No more than said number of prizes listed in these Official Rules will be awarded. Unclaimed prizes will not be awarded.
LIABILITY:
Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator and waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of these Official Rules. Winners and entrants also agree to release, discharge, indemnify, and hold harmless the Sponsor, its affiliates and their respective directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prize or participation in this Sweepstakes. Each winner agrees to take full responsibility for the actions of the guest who accompanies them to the chosen Atlanta Braves home game and agrees to follow all arena/park rules, regulations and guidelines, including safety and security rules. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any printing, technical or human error which may occur related to the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer only systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer related to, or resulting from, participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, for reasons relating to infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right to terminate the Sweepstakes prior to the end of the Promotion Period and award the Prize through a random drawing from among all eligible entries received up to the time of termination.
RELEASE:
If you indicate consent, Sponsor and its affiliates and agencies (collectively the “Released Parties”) will use the information you provide to contact you about other promotions and services offered by the Released Parties. This information will be retained by the Released Parties as required by applicable law.
DISPUTES:
Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rule and regulations of the State of New York without regard to its choice of laws or conflict of laws provisions.
